An application, filed by the petitioner, to be impleaded as a party (defendant) in the pending suit, has been dismissed by the Civil Court. The respondents (Meena Rani and Veena Rani) have filed a suit for possession on the basis of title. They claim to be the owners of the property by virtue of the sale deed dated 16.09.2004 executed by Bhola Nath, Darshan Kumar and Naresh Kumar, respectively. Admittedly, a separate suit, filed by the plaintiffs claiming property on the ground that she is the daughter of late Sh. Krishan Kumar son of Barma Devi, has been dismissed on 07.12.2019. No doubt, the appeal is pending. However, as of now, the petitioner has failed to prove any right, title or interest in the property. 2.
Keeping in view the aforesaid facts, the trial Court has not erred in dismissing the application. Consequently, the present revision petition is dismissed.
