The petitioner has filed the instant petition under Section 528 of BNSS seeking quashing of order dated 11.03.2025 (Annexure P-12) passed by learned Sessions Judge, Sri Muktsar Sahib in SC No.83 of 2023 having CNR No.PBSM010017512023 titled as State of Punjab Vs. Jasvir Singh in FIR No.212 dated 26.06.2020 under Section 21 of Mines and Minerals (Regulation of Development) Act, 1957 and Section 379 IPC, 1860 registered at Police Station City Muktsar, District Sri Muktsar Sahib whereby bail of the petitioner was cancelled and non bailable warrants have been issued qua him. 2.
Learned counsel for the petitioner contends that during trial, the petitioner has appeared on each and every date of hearing except on few dates on which the petitioner filed the exemption application to appear. He further states that on the date fixed i.e. 11.03.2025, he noted the wrong date due to which the petitioner could not appear on the date fixed and consequently, vide order dated 11.03.2025, the trial Court cancelled his bail and forfeited his bail bonds and surety Sonia Puri 2025.07.09 13:17 I attest to the accuracy and integrity of this document
CRM-M No.34899 of 2025 -2- bonds to the State and further he was issued summons through non bailable warrants. However, he submits that he is willing and ready to join the proceedings and shall appear before the trial Court as and when required. Learned counsel for the petitioner, on instructions further submits that the petitioner undertakes to appear before the trial Court on each and every date and shall not seek any exemption for his personal appearance on any date of hearing before the trial Court. Hence, in the aforementioned facts and circumstances, the petitioner prays that directions be issued to the Trial Court that his bail application, which he would be filing on his surrender, be decided. 3.
Keeping in view the facts of the case, the service of respondent is dispensed with as it will delay the proceedings. 4.
I have heard learned counsel for the petitioner and perused the material placed on record.

No ground to interfere in the impugned order dated 11.03.2025 is made out and the present petition is hereby, dismissed. 6.
However, in case the petitioner appears and surrenders before the trial Court concerned at 10.00 A.M. within a period of 07 days from today and files bail application before the concerned Court, the same shall be considered by the trial Court concerned on the very same date, in accordance with law. 07th July, 2025 (H.S.
