The petitioner seeks grant of anticipatory bail in respect of the aforementioned FIR.

At the time of issuance of notice of motion, the following order was passed on 12.8.2024:

"The petitioner seeks grant of anticipatory bail in respect of a case registered vide FIR No.186, dated 22.12.2015 at Police Station Ajnala, Amritsar Rural, District Amritsar, under Sections 307, 148, 149, 120-B of Indian Penal Code read with Sections 25, 27, 54, 59 of Arms Act.

( 2 ) Learned counsel for the petitioner submitted that although the petitioner is named in the FIR, but no specific role is attributed to him. It is submitted that the FIR came to be lodged under some kind of misunderstanding, which has now been resolved and the matter stands compromised amongst the parties. Learned counsel, in this regard, has drawn the attention of this Court to the compromise deed dated 6.7.2024 (Annexure P-9). Notice of motion for 9.1.2025.

At this stage, Mr. Harsh Vasu Gupta, Advocate has put in appearance on behalf of respondent No.2/complainant and has filed Power of Attorney, which is taken on record. He has endorsed the factum of compromise and has stated that he has no objection in case the petitioner is granted anticipatory bail. Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C."

Learned State counsel, upon instructions from the Investigating Officer, has informed that pursuant to interim directions issued by this Court on 12.8.2024, the petitioner has since joined investigation and he is not required for any custodial interrogation.

Having regard to the aforestated position, wherein the petitioner is stated to have joined investigation and is not required for any custodial interrogation and also that the matter has been amicably resolved amongst the parties, the petition is accepted and the interim directions issued by this Court vide order dated 12.8.2024 are hereby made absolute, subject to the condition that the petitioner shall join investigation as and when called
