Ms. Himani Kapila, Advocate, for the petitioner. ***** SUDHIR MITTAL, J. (ORAL) This petition has been filed for quashing of FIR No.83, dated 13.08.2021, registered at Police Station Qila Lal Singh, District Batala, under Sections 279, 304-A, 337, 338 & 427 IPC on the basis of compromise.

Learned counsel for the petitioner submits that the complainant has executed an affidavit dated 05.10.2021 (Annexure P-2) stating that the petitioner was not driving the offending vehicle and thus, the FIR deserves to be quashed.

A Division Bench of this Court has held in Baldev Singh vs. State of Punjab and another, CRM-M-40769-2014 decided on 02.06.2016 that an FIR under Section 304-A IPC cannot be quashed on the basis of compromise.

Faced with this situation, learned counsel for the petitioner wishes to withdraw this petition.

Dismissed as withdrawn.
