The present second petition has been filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (erstwhile Section 439 of Cr.P.C) read with Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (erstwhile Section 482 of Cr.P.C.) for grant of interim bail for 10 days to the petitioner in case bearing FIR No.57 dated 22.04.2025 under Sections 103/351(2)/191(3) of BNS, 2025 (erstwhile Sections 103/148/149 of IPC) and Sections 25/27 of Arms Act, 1959 (offence under Sections 111/112/61(2) and 262 of BNS added later on) (erstwhile Sections Nil in IPC, Nil in IPC, 120-B, 224 of IPC) registered at Police Station City Fazilka, District Fazilka, to attend afterdeath ceremonies of his mother.

Learned counsel for the petitioner inter alia contends that the mother of the petitioner had unfortunately passed away on 08.06.2026 and her last rites and Bhog Ceremony is scheduled to be fixed for 20.06.2026 as discernible from the Panchayatnama (Annexure P-2). Mr. Vikas Sonak, AAG, Punjab puts in appearance and accepts notice on behalf of the respondent-State and seeks time to have instructions in this regard.

Having heard learned counsel for the parties and after perusal of Annexure P-2, it transpires that mother of the petitioner had passed away on 08.06.2026 and her Bhog Ceremony is scheduled to be fixed for 20.06.2026 from 10:00 A.M. to 01:00 P.M. at his native place. 6.
In view of the facts and circumstances of the case, the present petition is allowed and this Court observed that the petitioner is required to attend the Bhog Ceremony of his mother which will take place on 20.06.2026 and, therefore, the jurisdictional police authorities are directed to take the petitioner in police escort to his native place to attend the Bhog Ceremony of his mother at 09:30 A.M. on 20.06.2026 (i.e. tomorrow morning) and shall produce/lodge the petitioner before the jail authorities by 04:00 P.M. on 20.06.2026 (i.e. tomorrow afternoon).
