(ORAL) Challenge in the present petition is to the order dated 22.07.2019 passed by learned Sub Divisional Judicial Magistrate, Panchkula in Case MNT No. 277 of 2019 titled as 'Rubina and another vs. Nishar', whereby petition filed by the petitioners under Section 125 Cr.P.C. has been dismissed for want of prosecution as well as on account of default in appearance.

The present petition pertains to the year 2019. Perusal of the order sheets shows that notice of motion has not been issued yet. On the last date of hearing i.e. 19.10.2023 passed by a Coordinate Bench of this Court, it has been stated as under:- "It has been noticed that the petitioners are not putting appearance themselves or through their counsel. DIVYANSHI 2024.08.01 09:38 I attest to the accuracy and integrity of this document

As per office report, learned counsel for the petitioner is duly informed. Even today, none has appeared on behalf of the petitioners. Therefore, it can safely be presumed that the petitioners or their counsel are not interested in pursuing the present petition. In view of the above, present petition is dismissed for nonprosecution.
