AMIT RAWAL J. (Oral) Prayer in present writ petition is for issuance of a writ in the nature of mandamus directing respondents to select and appoint the petitioner being meritorious candidate to the post of Post Graduate Teacher (PGT) Hindi under Schedule Caste Category against those two posts which were earlier kept reserved in compliance of the order of this Court. Notice of motion.
On asking of Court, Mr. R.K.Doon, Assistant Advocate General, Haryana, who is present in Court, accepts notice on behalf of respondents/State.
Mr.Mohan Singla, learned counsel appearing on behalf of petitioner submits that in pursuance to Advertisement No.4 of 2015, caused for filling up 367 posts of PGT Hindi, petitioner applied for the aforementioned post under Schedule Caste Category. After having participated in the selection process, she secured 100 marks in written examination and last short listed candidate for interview in the SC Category SAVITA KADIAN 2019.09.18 16:58 I attest to the accuracy and integrity of this document High Court Chandigarh
CWP No.24099 of 2019 {2} secured only 98 marks despite that she has not been called for interview. Petitioner filed CWP No.21720 of 2018 wherein vide interim order dated 29.08.2018, allowed her for provisional interview and she cleared the same by securing 18 marks. This Court dismissed aforementioned writ petition but gave liberty to the petitioner to approach this Court again in case SC Category vacancies remain vacant. Without adhering to the aforementioned directions, respondents caused an advertisement dated 22.08.2019 (Annexure P-13) and in this regard, petitioner has submitted representations dated 22.07.2019 (Annexures P-11 and P-12) but no action has been taken so far. The predicament of petitioner is writ large.
In view of statement made by learned counsel for the petitioner and without going into merit of case or commenting thereon, present writ petition is disposed of with a direction to respondents No.2 and 3 to decide the representations dated 22.07.2019 (Annexures P-11 and P-12) by passing a well reasoned and speaking order within a period of one month from the date of receipt of certified copy of this order. In case, representation is not decided within aforementioned specified time, there shall be costs of Rs.25,000/- to be paid by the concerned officer to the petitioner.
