Learned counsel for the appellant submits that the matter has been amicably settled with the claimants. Under the settlement, a sum of `1 lac was paid on 06.02.2016 and the remaining amount of `3,50,000/- was to be paid on 29.04.2016, on which date `2,50,000/- has been paid and remaining `1 lac will be paid on 29.07.2016. To this effect, he has placed on record copy of the order dated 06.02.2016 passed by the executing Court and the copy of statement of claimants.

In view of the settlement, he seeks withdrawal of this appeal.

Dismissed as withdrawn.

The statutory amount of `25,000/- deposited by the appellant, be sent to the executing Court to adjust in the outstanding amount under the settlement between the parties.
