CHANDIGARH RA-CW-282-2025 in/and CWP-5580-2025 (O&M) Decided on : 10.11.2025 UNION OF INDIA & OTHERS . .Applicant

Versus

RUMLA DEVI & ANR . . . Respondents CORAM: HON'BLE MR. JUSTICE HARSIMRAN SINGH SETHI HON'BLE MR. JUSTICE DEEPINDER SINGH NALWA PRESENT: Mr. Chakshu Sharma, Advocate for the review applicant-respondent No. 1.

Mr. Naveen Gupta, Advocate for the non-applicant-petitioners.

**** HARSIMRAN SINGH SETHI , J. (Oral) RA-CW-282-2025 1.

Prayer made in the present review application is for reviewing of the order dated 27.05.2025 passed by the Co-ordinate Bench of this Court by which, the writ petition filed by the non-applicant/petitioners was allowed. 2.

Learned counsel for the review applicant submits that one of the ground taken by the Co-ordinate Bench of this Court while allowing the writ petition filed by the non-applicants/petitioners is that the order of discharge from service of husband of respondent no. 1 was not challenged, whereas the non-applicant/petitioners themselves stated that there was no order of discharge passed, therefore, the order dated 27.05.2025 passed by the Coordinate Bench of this Court is on incorrect facts and the same is liable to be reviewed.

3.

On the other hand, learned counsel for the non-applicant/petitioners is not able to dispute the said fact. RIYA 2025.11.12 16:40 I attest to the accuracy and integrity of this document

RA-CW-282-2025 in/and CWP-5580-2025 (O&M) -24.

We have heard learned counsel for the parties and have gone through the case file with their able assistance. 5.

It is a conceded fact that there was no order of discharge from service of the husband of respondent no. 1 whereas, only on the basis of the Red Ink Entry, the husband of respondent No. 1 was discharged from service, be that as may, one of the fact relied upon by the Co-ordinate Bench of this Court to arrive at a conclusion while deciding the writ petition is based upon the incorrect facts, therefore, the prayer made in the review application is allowed.

6.

Consequently, the order dated 27.05.2025 passed by Co-ordinate Bench of this Court is recalled and the writ petition is restored to its original number and status.
