The applicant-wife has filed the present application for seeking transfer of the divorce petition, filed at the instance of the respondent-husband, pending in Family Court Kapurthala and she seeks transfer of the same to the Court of competent jurisdiction at Jalandhar. It is submitted by learned counsel that two children born from the wedlock of the parties to the lis, who are aged 8 years and 4 years, are in the care and custody of the applicant. Even, the applicant has filed petition under Section 125 Cr.P.C., which is already pending in the Courts at Jalandhar. Furthermore, it is also pointed out by learned counsel that earlier also, the petition under Section 13 of the Hindu Marriage Act was filed at the instance of the respondent-husband at Kapurthala. However, in pursuance of the transfer application, filed at the instance of the applicant, vide order dated 13.09.2022 (Annexure P-4), passed by this Court, the divorce petition was transferred from Kapurthala to Jalandhar. However, after the transfer of the previous divorce petition, the respondent had withdrawn the same.
