Prayer in the present writ petition under Articles 226/227 of the Constitution of India is for issuance of a direction to the respondents to release the pending DA arrears, which was increased from 80% to 90% for the period 01.07.2013 to 31.01.2014 and thereafter, increased from 90% to 100% for the period 01.01.2014 to 30.09.2014 and further increased arrears from 100% to 107% for the period 01.07.2014 to 28.02.2015 and also to release the pending arrears of IR of 50% for the month of January, 2017 and LTC arrears and further to release the pending arrears/financial benefits of promotions as per the office orders along with interest @ 12% per annum. Learned counsel for the petitioners would contend that in this regard a legal notice dated 20.09.2021 (Annexure P-8) has been sent to respondent No.

2, however, no decision has been taken so far. Learned counsel for the petitioners would further contend that at this stage the petitioners would be satisfied if a direction is issued to respondent No.2 to JITENDER KUMAR 2021.11.

CWP No. 22497 of 2021 -2take a decision on the legal notice dated 20.09.2021 (Annexure P-8) and to release the arrears in a time-bound period.

Notice of motion.

On the asking of the Court, Mr. Ajaivir Singh, Advocate, who has joined the session through video conferencing, accepts notice on behalf of the respondents and he states that he has no objection if the present petition is disposed off with a direction to respondent No.2 to take a decision on the legal notice dated 20.09.2021 (Annexure P-8) and to release the arrears as found due towards the petitioners in a time-bound period. Heard.

In view of the above and without commenting on the merits of the case, the present petition is disposed off with a direction to respondent No.2 - Registrar, Punjabi University, Patiala - to take a decision on the legal notice dated 20.09.2021 (Annexure P-8) expeditiously, in accordance with law, and in any case within a period two months from the date of receipt of a certified copy of this order. The cumulative arrears found to be due towards the petitioners be released within one month thereafter. The petitioners would be at liberty to agitate their rights qua receiving of interest on the delayed payment. Disposed off.
