Petitioner seeks quashing of orders dated 17.10.2025 and 06.02.2026 of learned Judicial Magistrate Ist Class, Fazilka vide which nonbailable warrants have been issued against him in FIR No.66 dated 18.06.2024 under Section 307, 323, 324, 336, 160, 148, 149 IPC, Sections 25 and 27 of the Arms Act, 1959, Police Station Arniwala, District Fazilka. 2.

Learned counsel for the petitioner submits that petitioner who was accused in aforementioned FIR, was granted bail by learned Additional Sessions Judge, Fazilka vide order dated 20.09.2024. Supplementary challan was presented in the Court on 26.08.2025 and notice was issued to the petitioner for 03.10.2025. Learned Trial Court, without waiting for report of service of notice, issued non-bailable warrants against the petitioner on 17.10.2025 and again on 05.12.2025, 19.12.2025 and 06.02.2026. Learned counsel further submits that petitioner was ready and willing to surrender in the Court but was fearful on account of non-bailable warrants of arrest issed. The impugned orders, without proper service of petitioner deserved to be quashed.

Mr. Kunwarbir Singh, AAG Punjab accepts notice on behalf of respondent State and opposes the prayer of the petitioner. 5.

Petitioner was released on anticipatory bail in the aforementioned FIR vide order dated 20.09.2024. Order of anticipatory bail enures during the trial. Perusal of orders dated 03.10.2025, 17.10.2025, 05.12.2025, 19.12.2025 and 06.02.2026 reveal that petitioner is still on bail and bail has not been cancelled. Non-bailable warrants have been issued only to procure his presence. Petitioner is accordingly directed to put in appearance before learned Judicial Magistrate Ist Class, Fazilka within 10 days from today. Till then, non-bailable warrants of arrest of the petitioner shall remain in abeyance.

The petition stands disposed of, on the above terms. 7.
