CORAM:HON'BLE MR. JUSTICE AMIT RAWAL -.- AMIT RAWAL J. (ORAL) The grievance of the petitioner is that the impugned order whereby the respondent No.9 had been appointed a Lambardar, though the procedure followed for filling up the post was duly notified despite that the petitioner did not move the application. The petitioner only joined at the stage when the proceedings at the instance of other persons i.e Pritam Kaur was being taken before the learned Commissioner and wanted his name to be considered. Respondent No.9 was the recommended candidate.
Once the petitioner has not applied for the post of Lambardar, his right cannot be brought in the zone of consideration at the stage when the matter has reached to the Financial Commissioner at the instance of the person who had not been appointed, despite having moved the application within the time frame, in essence, the petitioner had lost the right of consideration by not moving the application at the appropriate time. The order of dismissing the application is perfectly legal and justified. No ground for interference is made out. The writ petition is dismissed.
