(ORAL) The petitioners are seeking quashing of FIR No.131 dated 27.07.2017 under Sections 447, 511, 427, 34 and 120-B IPC, registered at Police Station Kharar, District SAS Nagar, Punjab on the basis of compromise dated 03.08.2017 (Annexure P-2), which has been arrived at between the parties.

Vide order dated 11.02.2022, the parties were directed to appear before the learned Illaqa Magistrate/trial Court for recording their RAJ KUMAR ARORA 2022.08.10 18:10 I attest to the accuracy and integrity of this document

CRM-M-46166-2022 respective statements with regard to compromise/settlement. A report has been received from the learned trial Court wherein, it has been stated that none of the parties had appeared before the learned Illaqa Magistrate/trial Court to get their respective statements recorded. The matter was taken up again on 07.04.2022 when the parties sought yet another opportunity to get their statements recorded before the learned Illaqa Magistrate/trial Court in respect of the compromise. A report vide memo No.512 dated 08.07.2022, has also been received from the learned Judicial Magistrate First Class, Kharar, wherein, it has been reported that the parties have chosen not to appear before the Court to get their statements recorded.

Today, there is no representation on behalf of either of the parties. It appears that the compromise has not yet been materialised between the parties.

The present petition is, accordingly, dismissed. Liberty, however, is granted to the parties to file appropriate application on a renewed cause of action. August 8, 2022. (VINOD S.
