(ORAL) The contention of learned counsel appearing for the petitioner is that as per the order of this Court dated 17.02.2017 passed in CWP No.3069 of 2017 (Annexure P-8), a direction was issued to the Financial Commissioner to decide the ROR No.186 of 2016-17 along with application for stay within a time line. However, according to Mr. Sahu, on 27.02.2017, the revision petition had been heard and reserved for orders but the order has not been pronounced yet.
Since the revision petition was preferred against the order of Commissioner, remanding the matter back to the Deputy Commissioner, the Deputy Commissioner is insisting upon hearing of the matter which fact is reflected from the zimni orders (Annexure P-9 colly) and the next date for argument is fixed as 07.03.2017.
I am in full agreement with Mr. Sahu. Once the matter is reserved, the Deputy Commissioner should wait for the outcome of the same, particularly, in case the petitioner succeeds. Keeping in view of the aforementioned fact, I direct the Financial Commissioner-respondent No.1 to pronounce order in the PANKAJ KUMAR 2017.03.07 11:28 I attest to the accuracy and integrity of this document
CWP No.4600 of 2017 -2aforementioned revision petition, stated to be reserved on 27.02.2017, in order to save the predicament of the petitioner, much less, multidimensional fall out of not passing the order, as expeditiously as possible and preferably within a period of one week. Till that time, the Deputy Commissioner shall not insist the petitioner to argue the matter on remand. It is further made clear that in case the Financial Commissioner decides the matter, the natural consequence shall be seen by the Deputy Commissioner, if need be.
The writ petition stands disposed of in the above terms. A copy of this order be given to Mr. Sandeep S. Maan, Sr. DAG, Haryana for compliance of the order under the signatures of Reader attached to this Court.
