This application has been filed by applicant-respondent No.3Insurance Company for disposing of the matter in terms of the compromise. The appeal has been filed by the claimant for enhancement of the compensation awarded vide award dated 25.01.2013. The appellants have been awarded a sum of Rs.1,68,500/- as compensation along with interest at the rate of 7.5% per annum from the date of filing of the claim petition till realization.

Learned counsel for the parties state that the matter has been compromised whereby the respondent No.3-Insurance Company has agreed to pay a sum of Rs.3,50,000/- over and above award amount. Both Ld. Counsel state that the amount awarded by the Tribunal has already been paid to the claimants.

Learned counsel for the non-applicant-appellant has placed on record an affidavit of Raj Kumar s/o Sh. Man Bahadur (appellant) stating that he has no objection if the appeal is disposed of in terms of compromise. CM No.5003-CII of 2016 IN/AND -2FAO No.4515 of 2013 (O&M) Accordingly, this application is allowed and the appeal is disposed of in terms of the compromise. Ld. Counsel for the respondent No.3-Insurance Company would hand over a cheque of Rs.3,50,000/- to learned counsel for the non-applicant-appellant within a period of six weeks from today.
