**** RAJ MOHAN SINGH, J. (Oral) Petitioner seeks grant of anticipatory bail in case bearing FIR No.0155 dated 01.11.2020 registered under Sections 18(c), 29, 61 of the NDPS Act, 1985 at P.S. Bahawala, District Fazilka.
Notice of motion was issued on 11.12.2020 and arrest of the petitioner was stayed on the premise that the petitioner was one of the occupants of a pilot car and was not apprehended at the spot. The pilot car was allegedly followed by one more car i.e. Scorpio car from which Lovepreet Singh and Surinder Singh were apprehended with 3 kg 100 grams of opium. Petitioner was directed to join investigation vide order MOHMED ATIK 2021.09.02 17:23 I attest to the accuracy and integrity of this document

Learned State counsel on instructions from ASI Devinder Singh submits that the petitioner has joined the investigation to the entire satisfaction of the Investigating Officer. Custody of the petitioner is no more required for further investigation of the case, but he is having antecedent behaviour of criminal activity as he is involved in number of NDPS cases. On a pointed query, learned State counsel replied that of course petitioner is on bail in those other cases. Taking into consideration the aforesaid facts, the interim order dated 22.01.2021 is made absolute. Petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.
Petition stands disposed of.
