The present petition has been filed under Section 528 of BNSS, 2023, to direct respondent No.2 to take action against respondents No.4 to 6 for letting respondents No.7 to 11 to take possession of land of the petitioner in illegal manner and for not taking any action against respondents No.7 to 11 and for wrongly supporting and helping respondents No.7 to 11 to take possession of the land of petitioner in illegal manner. Further prayer has been made to direct respondent No.2 to conduct fair and impartial investigation into the complaint No.2233/PM/2023 (Annexure P-1) moved by petitioner against respondents No.7 to 11.

Learned counsel for the petitioners, inter alia, contends that the petitioner is a senior citizen and has been in peaceful possession of 14 kanals of land situated at village Chakerian, District Mansa since 2003 based on a duly executed agreement to sell for full consideration, as acknowledged in official inquiry reports and compensation records. Due to the petitioner's prior litigation i.e. CWP No. 8971 of 2022 against District Police Mansa, certain police officials i.e. respondents No.3 to 6 developed animosity and in collusion with private respondents they involved in land mafia activities and facilitated the petitioner's illegal dispossession in October, 2023 and destruction of standing wheat crop. Despite there being clear evidence, respondent No.2 has failed to register an FIR or conduct a fair investigation into the matter and further in spite of filing a representation with police authorities on 13.12.2024, no action has been taken so far.

Learned counsel for the petitioner further submits that the petitioner would be satisfied, in case a direction is issued to respondent No.2 to consider and decide the representation dated 13.12.2024 (Annexure P-5) submitted by the petitioner in a time bound manner. 4.

On asking of the Court, Mr. Subhash Godara, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1 to 4 - State. Learned counsel for the petitioner is directed to supply copy of complete paperbook to counsel opposite during the course of the day. 6.

Keeping in view the prayer made by the petitioner and without commenting anything on the merits of the case, the present petition is disposed of with a direction to respondent No.2 to consider and decide the representation dated 13.12.2024 (Annexure P-5) submitted by the petitioner within a period of four weeks from the date of receipt of certified copy of this order, in accordance with law.
