The present petition has been filed under Section 482 Cr.P.C. for quashing of order dated 03.04.2023, Annexure P-9 passed by Sessions Judge, Gurdaspur in CRR No.138 of 2022 vide which the Revisional Court has set aside the order dated 29.09.2022, Annexure P-7 passed by learned JMIC, Batala. 2.

After arguing for some time, learned counsel for the petitioner wishes to withdraw the present petition.

Dismissed as withdrawn.

However, to ward off the apprehensions as expressed by the learned counsel for the petitioner during the course of arguments, it is clarified that the observations made by the Revisional Court shall have no bearing whatsoever, on the merits of the case. The trial Court shall proceed uninfluenced therefrom while deciding the matter.
