Learned State counsel refers to para Nos.7, 10, 12 and 13 of the reply dated 19.01.2021 filed by Deputy Superintendent of Police, Government Railway Police, Amritsar, which reads thus:

"7. That the contents of Para No.7 of the petitioner are denied being wrong and correct. It is denied that on 09.08.2020 at about 5:00 PM, the respondent No.5 had committed any of the alleged acts as mentioned while arresting the petitioner. The allegations of the petitioner that the respondent No. 5 and Police party accompanying him broke the gate of her house with the help of a tractor, or uprooted the house, or took away Rs. 4,40,000/-, gold jewelry, pass books, bills of the shop, or the DVR used for recording, from the house of the petitioner have not been proved during the detailed enquiry conducted by the deponent. The photographs Annexure P/4 do not prove the allegations of the petitioner in any manner.

That in reply to the contents of Para No. 10 of the petition, it is submitted that during the detailed enquiry conducted by the deponent, the petitioner could not prove the allegations about taking away of Rs. 4,40,000/- and gold articles by the respondent No. 5 at the time her arrest on 09.08.2020, or about the alleged payment of Rs. 1 lakh to him MOHIT 2025.09.03 10:04 I attest to the accuracy and integrity of this document

CRM-M-41825-2020 (O&M) -2at the police station, or about the giving of electric shocks to her. As such, her allegations were found to be false and vitiated with malice and mala-fide intentions.

That in reply to the contents of Para No. 12 of the petition, it is submitted the petitioner had filed a complaint No. 42904/complaints branch dated 13.11.2020 to the Assistant Inspector General of Police, G.R.P. (Punjab), Patiala making allegations against the respondent No.5 and police officials accompanying him at the time of arrest of the petitioner on 09.08.2020. The Assistant Inspector General of Police, G.R.P. (Punjab), Patiala marked the said complaint to the deponent for a detailed enquiry into the allegations of the petitioner. After conducting detailed enquiry, the deponent has concluded that there is no truth in the allegations made by her and she had made a false complaint against the Police employee to save herself from the proceedings of the case.

The deponent had recommended for the consigning of the complaint by submitting the detailed Enquiry Report No. 2188/R dated 23.12.2020 to the A.I.G., G.R.P. (Punjab), Patiala. The Representation dated 28.09.2020 (Annexure P-6) allegedly sent by the petitioner to the respondent No. 3 through the registered post has not been forwarded to the G.R.P., Punjab by the office of the respondent No.3.

13. That in reply to the contents of Para No. 13 of the petition, it is submitted that the detailed Enquiry Report No. 2188/R dated 23.12.2020 has been submitted to the A.I.G., G.R.P. (Punjab), Patiala by the deponent after enquiring into the allegations of the petitioner made by her in the complaint No. 42904/complaints branch dated 13.11.2020 filed by her against the respondent No.5 and other police officials but the petitioner failed to prove her allegations against them so the deponent had recommended for the consigning of the complaint."

In view of the above, no further orders are required to be passed. 3.

Learned counsel for the petitioner prays for liberty to submit a representation or avail of alternate remedy, that may be available to him, in accordance with law.
