Prayer is for grant of anticipatory bail in FIR No.230 dated 17.09.2021, registered under Sections 120-B, 406, 420, 467, 468, 471 of IPC, registered at Police Station Sector-53, District Gurugram. 2.

Learned counsel for the petitioner has submitted that the petitioner has complied with the order dated 15.02.2024 and has joined the investigation.

Learned State counsel on instructions from SI Rajbir has submitted that although the petitioner has joined the investigation but is not cooperating in the investigation.

Learned counsel for the petitioner has relied upon copy of order dated 15.03.2023 (Annexure P-12) passed by Coordinate Bench of this Court in another matter bearing CRM-M-53702-2022, wherein the authorities had stated that custodial interrogation of the petitioner is not required.

In light of the above and considering the age of the petitioner who is 77 years old, the order dated 15.02.2024 granting interim anticipatory bail to the petitioner, is made absolute. However, the petitioner shall join the investigation as and when called upon to do so by the Investigating Agency and shall abide by the conditions of Section 438 (2) Cr.P.C.

However, nothing stated above shall be construed as a final expression of opinion on the merits of the case and this order shall not be construed as parity qua any other co-accused. 7.

It is made clear that, in case, the petitioners are found involved in any such activity once again, the State is at liberty to promptly move an appropriate application for cancellation of bail detailing out the circumstances and violation of the condition(s) of bail.
