Respondent proceeded against ex parte vide order dated 07.08.2025.

(Oral) The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/161/2023, titled 'Anmol Kumar Vs. Akanksha', filed by the respondent-husband, pending in the Family Court, Ambala and she seeks transfer of the same to the Court of competent jurisdiction at Jalandhar. Upon notice, the respondent did not make appearance, despite service and as such, was proceeded against ex parte. Counsel for the applicant heard.

It is submitted that one son born from the wedlock of the parties to the lis, who is about 6 years old, is in the care and custody of the applicant. The applicant is not having any source of earning and as such, is dependent upon her parental family. Even, she has filed the petition under Section 125 Cr.P.C. i.e. MNT-125/34/2023, as well as the petition under the Sonu 2025.08.29 15:49 I agree to specified portions of this document P&HHC

TA-1011-2023 Protection of Women from Domestic Violence Act i.e. COMA/136/2023, which are pending in the Courts at Jalandhar and the respondent is making appearance in the same. The distance between the two places is stated to be about 170 kilometres.

In view of the aforesaid mitigating circumstances, more particularly, while considering the fact of the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/161/2023, titled 'Anmol Kumar Vs. Akanksha', filed by the respondent-husband, stands transferred from the Family Court, Ambala, to the Court of competent jurisdiction at Jalandhar. The requisite record of the aforesaid case be sent by the Family Court, Ambala, to the District and Sessions Judge, Jalandhar. Learned District and Sessions Judge, Jalandhar, shall assign the said petition to the Family Court, Jalandhar. Even, the parties are directed to appear before the Family Court, Jalandhar, within a period of one month from today onwards.
