*** HARSIMRAN SINGH SETHI , J. (ORAL) The grievance which is being raised by the petitioner is that though, he had retired on 31.07.2018, but even after expiry of more than one year, some of his pensionary benefits, for which he is entitled, has not been released.

Counsel for the petitioner argues that the benefits of leave encashment, arrears of dearness allowance, gratuity and GIS are yet to be paid to the petitioner. Counsel prays that a direction be issued to the respondents to release the said benefits immediately alongwith interest. Counsel for the petitioner further states that for the relief which is claimed in the present writ petition, petitioner has served the respondents with a legal notice dated 31.05.2019 (Annexure P-6) and in reply to the said legal notice, respondents have stated vide letter dated NARESH KUMAR 2019.09.04 13:11 I attest to the accuracy and integrity of this document Chandigarh

CWP-23323-2019 -221.06.2019 (Annexure P-7) that case of the petitioner has been sent for approval of the sanctioning of the budget for the release of the arrears of dearness allowance, but no action is being taken for the release of the pensionary benefits, which are also being withheld. Counsel for the petitioner states that petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to take a final decision in respect of the legal notice dated 31.05.2019 (Annexure P-6) by passing an appropriate speaking order. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 31.05.2019 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
