**** HARSIMRAN SINGH SETHI , J. (ORAL) Petitioner has challenged the inquiry proceedings as well as the subsequent order dated 06.09.2017 (Annexure P-14) by which he has been dismissed from service. The impugned order by which the petitioner has been dismissed from service is an appealable order but the present writ petition has been filed without availing the remedy of appeal. Faced with the situation, counsel for the petitioner prays that he may be permitted to withdraw the present writ petition with liberty to file an appeal against the order causing prejudice to the petitioner including the order of dismissal.

The request of the petitioner is accepted.

CWP-30112-2018 -2As the petitioner is a litigant since the year 1984 and long time has already elapsed and he has already attained the age of superannuation. In case the petitioner files an appeal within a period of four weeks from today, the respondents are directed to decide the same on merits, without rejecting the same on delay, by passing a speaking order, within a period of three months from the date the petitioner submits the appeal.
