Learned counsel for the parties concedes the factum that keeping in view the judgment of the Division Bench of this Court in LPA No.1908 of 2018 titled "Savitri Devi Vs. Presiding Officer, Industrial -cum-Labour Court and ors.", decided on 12.09.2024, the claim of the petitioner that the impugned award dated 04.05.2018 (Annexure P-3) passed by the labour Court is bad, as the claim of the petitioner has been held to be nonmaintainable and the petitioner was directed to approach the Educational Tribunal for adjudication upon her claim has to be upheld. 2.

Keeping in view the judgment of the Division Bench of this Savitri Devi's case (supra), the impugned award dated 04.05.2018 (Annexure P-3) is set aside and the Labour Court is directed to consider the reference raised by the petitioner and decide the present case on the basis of the facts and evidence, which will come on record hence, the present petition is disposed of in terms of LPA No.1908 of 2018 titled "Savitri Devi Vs. Presiding Officer, Industrial Tribunal-cum-Labour Court and ors.", RIYA 2025.05.07 10:05 I attest to the accuracy and integrity of this document
