Petitioner has approached this Court praying for quashing of impugned orders, Annexures P-9 and P-10, dated 04.02.2019 and 20.03.2020 respectively passed by Assistant Registrar and Deputy Registrar Cooperative Societies Hoshiarpur respectively, and also against the order dated 26.08.2020, Annexure P-15, passed by the Assistant Registrar by rejecting the objections against the notice issued under the Punjab Land Revenue Act, 1887 for recovery of the amount as arrears of land revenue. Further prayer has been made for restraining the respondents from using coercive methods to recover the amount and may recover the same by sale of mortgaged property.

Learned counsel for the petitioner submits that the petitioner has already availed the remedy of appeal and thereafter he has approached this Court by way of present petition. However, learned counsel for the respondent/Bank has submitted that petitioner without availing the remedy of revision under Section 69 of the Punjab Cooperative Societies Act has approached this Court and thus the present petition is not maintainable. 3.

However, learned counsel for the petitioner fairly submits that he may be allowed to withdraw the present petition with liberty to the petitioner to avail his remedy as available to him under the law. 4.

Allowed as prayed for.

Petition is dismissed as withdrawn with liberty aforesaid. 6.

However, if petitioner avails his remedy by 15.07.2024, then operation of arrest warrant would remain stayed till then. May 28, 2024 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
