Prayer in this writ petition filed under Article 226 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the order dated 05.07.2013 (Annexure P-5), vide which pension has been declined to the deceased husband of the petitioner. Further a writ of mandamus has been sought for directing the respondents to release the arrears of pension of deceased husband of the petitioner w.e.f. 31.07.2002 to 17.09.2008 (i.e. the date of death of husband of the petitioner), leave encashment and other pensionary benefits along with interest @ 18% per annum on account of delayed payments and further to direct the respondents to pay family pension to the petitioner w.e.f. 18.09.2008 till date along with arrears thereof with interest @ 18% per annum on account of delayed payments. Learned counsel for the petitioner wishes to withdraw the present petition, however, confines his prayer to the extent that all the remaining dues under the Contributory Provident Fund (CPF) be released in favour of the petitioner.

Learned counsel representing respondents No.2 and 3 very fairly concedes that in case the funds to which the petitioner is entitled has not been released, the same shall be released under the CPF Scheme within a period of three months from today.

In view of the above, the present petition is disposed of with a direction to respondent No.2, to look into the grievance of the petitioner and decide her claim within a period of 03 months from the date of receiving a certified copy of this order by passing a speaking order, after affording an opportunity of hearing to the petitioner. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the claim sought, the same shall be granted to her forthwith.
