RAJESH BHARDWAJ, J.(ORAL) CRM-W-1274-2022 Application for exemption is allowed as prayed for. CRWP-8917-2022 This is the second petition filed by the petitioners for issuance of direction to the respondents to grant them protection of life and liberty at the hands of respondent Nos.5 to 7.
On earlier occasion, the petitioners have approached this Court with a similar type of petition, i.e. CRM-M-22315-2022 and the same was disposed of by this Court vide order dated 23.05.2022. Counsel for the petitioners submits that in pursuance to the order passed by this Court on 23.05.2022, the respondent-authorities have duly carried out the medical examination of the prosecutrix and her statement under Section 164 Cr.P.C. was also recorded. He submits that now respondent Nos.5 to 7 are threatening the prosecutrix to compromise MEENU 2022.09.20 14:35 I attest to the accuracy and integrity of this document
CRWP-8917-2022 (O&M) -2the matter. He has submitted that he has already filed a representation to the respondent-authorities and no action has been taken on the same. After hearing the counsel for the petitioners and perusing the record, it is apparent that petitioner is approaching this Court time and again by filing similar type of petitions for the same relief. However, issue notice of motion.
On the asking of the Court, Mr.B.S.Virk, DAG, Haryana, who is present in Court, accepts notice and has submitted that the State has duly complied with the directions given by this Court by conducting the medical of the prosecutrix and recording her statement for the second time. He has submitted that the investigation is being conducted in a fair and impartial manner.
Heard learned counsel for the parties and perused the record. The petition is disposed of with liberty to the petitioners to file an appropriate representation and if they file the same within ten days from today, then the respondent-authorities are at liberty to decide the same in accordance with law.
