The petitioners have approached this Court under Articles 226/227 of the Constitution of India, for issuance of a writ in the nature of Mandamus directing the respondents to refix the pay of the petitioners by stepping up the same equivalent/at par with the juniors of the petitioners along with all the consequential benefits including arrears of difference of pay along with interest 18% per annum from the date the juniors to the petitioners are getting higher pay than the petitioners. Concededly, the petitioner No. 1-Nihal Singh had already been retired on 31.01.2017 from the post of Operator whereas petitioner No. 2Mushadi Lal is still working as Operator. The petitioners have already served legal notice dated 09.09.2016 (Annexure P-3) upon respondents No. 1 and 2, but no action has been taken so far.
Learned counsel for the petitioners submitted that the instant petition may be disposed of by directing concerned authorities to consider and decide the aforesaid legal notice Annexure P-3, in a time bound manner. Rishu Kataria 2017.05.
CWP-4856-2017 -2After hearing learned counsel for the petitioners, perusing the paper-book and without commenting upon the merits of the case, the present petition is disposed of directing the concerned authorities to consider and decide the legal notice Annexure P-3 served by the petitioners by passing a speaking order and affording an opportunity of hearing to the petitioners, within a period of two months from the date of receipt of certified copy of this order.
