(ORAL) By way of present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 , petitioner seeks quashing of FIR (Annexure P-4) and all consequential proceedings arising therefrom. Learned counsel for the petitioner contends that the Police after investigating the matter had filed a cancellation report in the instant FIR, but the same was returned by the concerned Court vide order dated 10.07.2021 (Annexure P-5) with the direction to further investigate the matter and file the report within 6 months. However, till date, the same has not been filed by the investigating agency.

At the very outset, learned State counsel on instructions from SI Kulwinder Singh, P.S. Fatehgarh Sahib submits that the police has prepared the report and the same will be submitted within a period of 2 weeks. Faced with this, learned counsel for the petitioner has sought withdrawal of the present petition at this stage with liberty to file the same afresh in accordance with law if so required in future. 5.
