Prayer made in the present petition is for quashing of condition imposed in the order dated 02.06.2023 in criminal complaint No.NACT-465-2022 dated 13.06.2022 titled as 'Surender Singh vs. Sandeep Kumar' under Section 138/142 of NI Act, vide which the petitioner has been directed to pay 20% of the cheque amount to respondent No.1.

Learned counsel submits that there were two complaints filed, one against the petitioner and the other against his brother. Similar conditions had passed in the orders of both cases i.e. on 02.06.2023 of 20%. His brother Pradeep Kumar had filed CRM-M-39661-2023 titled as Pardeep Kumar vs. Surender Singh and Another, which was disposed of vide order dated 14.02.2024 modifying the order of Additional Chief Judicial Magistrate Narnaul to the extent that the Court will not insist the petitioner to pay 20% of the cheque amount as a condition of the bail.
