(Oral) The appellants-grand parents had filed the petition under Section 7 of the Guardian & Wards Act, 1890 and Section 25 of the Hindu Minority and Guardianship Act, 1956, seeking temporary custody of minor grand children and in alternative seeking regular visiting rights. The trial Court had dismissed the aforesaid petition vide impugned judgment dated 6th February, 2016.

Learned counsel for the appellants claimed that the visiting rights have not been granted by the trial Court. However, on a query being put to the learned counsel for the appellants, as to whether this point was urged before the trial Court, it was submitted that he may be allowed to withdraw the present appeal with liberty to the appellants to file an appropriate application seeking regular visiting rights to meet the grand children namely Bhumika and Hitesh. 3.

After hearing learned counsel for the appellants, the appeal is dismissed as withdrawn. However, the appellants shall be at liberty to file an appropriate application before the trial Court claiming regular visiting rights to meet their grand children namely Bhumika and Hitesh, which shall be decided by the trial Court in accordance with law.
