HARINDER SINGH SIDHU, J Prayer is for grant of regular bail in case FIR No.77 dated 25.12.2018 under Section 21, 27-A, 29 NDPS Act, 1985 Police Station Mohkampura District Amritsar.

As per allegations in the FIR the petitioner was driving i-20 Car. Ajay Pal Singh was his co-passenger. On receipt of secret information the car was intercepted and 300 grams of Heroin was recovered from copassenger Ajay Pal Singh. Besides, a sum of Rs.1,00,000/- was recovered from the personal search of co-accused Ajay Pal Singh, Rs.50,000/- were recovered from the personal search of the petitioner whereas another sum of Rs.2,00,000/- were found from the dashboard of the Car. Learned counsel for the petitioner contends that the petitioner has been falsely implicated in this case. False recovery has been foisted upon the petitioner and that he is in custody since 25.12.2018. Opposing the petition, the learned State counsel has submitted that the petitioner is involved in four other criminal cases. CRM-M-35593 of 2019 #2# criminal cases, the alleged recovery is of small quantity and the petitioner is on bail in all the cases.

Without commenting anything on the merits of the case and also bearing in mind the custody period, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Subeg Singh @ Bunty is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
