 $ For the reasons stated in CM 5785 CII 2016, the delay of 32 days in filing the appeal is condoned.

Two appeals i.e. FAO No.1522 and 1523 of 2016 arising out of the same impugned Award, filed by the appellant seeking the similar relief, have already been dismissed on 11.3.2016 leaving it open to the appellant to take any appropriate proceedings to sue the joint tortfeasors in accordance with law.

In view of above, the present appeal is dismissed in the same terms as FAO No.1522 and 1523 of 2016.
