This is a civil writ petition under Articles 226/227 of the Constitution of India for directing respondent Nos.3 and 4 to preserve and keeping the ballot papers and entire election record intact pertaining to Ward No.46, Municipal Council, Pathankot.

Learned Additional Advocate General, Punjab, has submitted that the Election Tribunal has already been constituted and is operational and since the election has already taken place, thus, in view o the judgment of the Constitution Bench in the case of Prithvi Raj Versus State Election Commission and others 2007(3) RCR (Civil) 817, the present writ petition is not maintainable.

Learned counsel for the petitioner has submitted that in view of the same, the petitioner be permitted to withdraw the present petition but has PUNEET SACHDEVA 2026.06.24 13:36 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.19327 of 2026 further submitted that ballot papers be preserved till the filing of the election petition and the videography undertaken during the course of election be also preserved till the filing of the election petition. 4.

Learned counsel appearing for the State has very fairly submitted that the same would be done.

Keeping in view the abovesaid facts and circumstances, the petitioner is permitted to withdraw the present petition with liberty to seek alternate remedy in accordance with law.
