(ORAL) The contention of the petitioners is that a no confidence motion has been passed by the 9 member councilors against the President of the Municipal Committee on 20.07.2016 and therefore, as per Rules 70 and 70B of the Haryana Municipal Election Rules, 1978, the Deputy Commissioner is enjoined upon to set out the election process but the same has not been done so far.
In this regard, a legal notice dated 14.01.2017 (Annexure P-5) has been issued to the Deputy Commissioner but no action has been taken so far and they will be satisfied if a direction is issued to the 2nd respondentDeputy Commissioner, Rohtak, Haryana to consider the legal notice dated 14.01.2017 (Annexure P-5) within a stipulated time. Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct 2nd respondent-Deputy Commissioner, Rohtak, Haryana to consider the legal notice dated 14.01.2017 (Annexure P-5) within a period of one month from the date of receipt of certified copy of this order and shall pass a speaking order thereon.
