Tribhuvan Dahiya, J (Oral) Learned counsel for the petitioners submits that it was only on account of misunderstanding between the defendants and their counsel in the trial court that written statement could not be filed on the date fixed, i.e., 12.04.2022. He prays for only one opportunity to enable the petitioners - defendants to file written statement before the trial court.

In the interest of justice, prayer is accepted and the impugned order dated 12.04.2022 is set aside to the extent defence of the petitioners - defendants has been struck off therein. Petitioners - defendants are granted one opportunity to file written statement before the trial court within seven days from today.
