(ORAL) In the present petition, the petitioners are praying for step up of their pay equivalent to their juniors, who belong to the reserved category and were promoted in preference to them. In respect of the claim, the petitioners are relying upon the instructions dated 14.03.2017 (Annexure P-6) issued by the respondents themselves, wherein it has been stated that the pay of the general category candidates, who after promotion were declared juniors to the reserved category, are entitled for step up of their pay after they catch them in the promotion cadre. Counsel for the petitioners further states that for the relief which has been claimed in the present writ petition, the petitioners have served a legal notice on 22.09.2018 (Annexure P-10), which is still NARESH KUMAR 2018.12.10 16:56 I attest to the accuracy and integrity of this document Chandigarh

CWP-30350-2018 -2pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 22.09.2018 (Annexure P-10) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners is entitled for any monetary benefit, the same shall also be released to them within a period of next three months.

Present writ petition stands disposed of.
