*** VIKRAM AGGARWAL, J (ORAL) This petition has been filed under Article 226 of the Constitution of India for the issuance of a writ in the nature of habeas corpus and for appointment of a Warrant Officer, with a roving writ to search for the alleged detenue, at the premises of respondents No.3 to 10 and get the detenue released from the illegal custody of respondents No.3 to 10. 2.
On 17.06.2026, the following order was passed:- "Learned counsel appearing on behalf of the petitioner inter alia contends that the official respondents have unlawfully detained detenueJatinder Singh i.e. son of the petitioner herein at the behest of the private respondents. He further contends that notwithstanding the petitioner having sustained injuries in an attack orchestrated by the private respondents themselves, the police is compelling the petitioner to enter into a settlement with the private respondents and in the said process, has illegally detained Jatinder Singh. It is further contended that neither any FIR has been registered so far nor any grounds of arrest have been supplied. It is further contended that Jatinder Singh has no criminal antecedents and that he is not involved in any other criminal case.
Without commenting on the merits of the present case, let a Warrant Officer be appointed to search the premises of respondent No.4 and such other place which may be indicated by the petitioner to the Warrant Officer to be the suspected place where the detenue may have been illegally detained and to secure his release. In case the detenue is found to be in illegal detention, then to take appropriate steps in accordance with law to secure his release.
CRWP-7282-2026 (O&M) -2The petitioner undertakes to deposit the necessary statutory charges as determined by law for appointment of Warrant Officer and also to arrange for the transportation of the Warrant Officer from Chandigarh and till his journey back.
The report may be filed on or before 23.06.2026." 3.
Today, the report of the Warrant Officer has been opened, which states as under:- "In compliance with the order dated 17.06.2026 passed by Hon'ble Mr. Justice Vinod S. Bhardwaj undersigned was appointed as Warrant Officer in the above noted case on 17.06.2026. I along with petitioner left Chandigarh at 06:30 pm on 17.06.2026. Counsel for petitioner met me in front of police post Butala District Amritsar and told that alleged detenue-Jatinder Singh had been taken by Kewal Singh, husband of sarpanch of village Rajadewal. He asked me and petitioner to follow his vehicle. After 3 K.M. from police post, Id. Counsel pointed out towards a person and told that he is alleged detenue-Jatinder Singh. On my asking, Kewal Singh told that Jatinder Singh had met him near police post and on his request he is going to drop him at his village. Thereafter, he had gone from there. I along with Jatinder Singh, petitioner and his counsel came back to police post Butala. Police post incharge ASI Tajinder Singh met there.
ASI Tajinder Singh furnished statement (Annexure R-1) to the effect that CCTV cameras installed in police post are out of order. After some time I/SHO police station Beas Gurviinder Singh and DSP Sukhpal Singh reached there. SHO told me that Jatinder Singh had neither been called in police station nor he is required in any case at this stage.
Jatinder Singh got recorded statement (Annexure R-2) to the effect he had been brought to police post Butala by 3/4 police officials at 5.30 am on 17.06.2026. He had been sent back home at 9.00 pm along with Kewal Singh, husband of sarpanch of village Rajadewal. He further stated that he had been tortured and mal-treated by the police officials of police post. Petitioner got recorded statement (Annexure R-3) to the effect that he is going home along with his son.
GD Entry made by the concerned police station are at Annexure R4. I left for Chandigarh at 1:40am from police station Beas on 18.06.2026.

In view of the report, learned counsel for the petitioner submits that the petitioner does not wish to press the instant petition and that the petitioner shall, if so advised, avail all such remedies as shall be admissible in law.
