(ORAL) In the present case, the petitioner is claiming that even though he retired from service on 30.11.2016, but the retiral benefits were not being paid due to pendency of the criminal case as well as in view of departmental proceedings pending against him. As per the averments made in the petition, vide judgment dated 10.08.2015 (Annexure P-2), the competent Court of law has acquitted the petitioner of the charges alleged against him under the Prevention of Corruption Act.

In respect of the disciplinary proceedings, the inquiry officer has already exonerated the petitioner, but still no order finalizing the inquiry has been passed by the respondents. Counsel for the petitioner further states that for the relief which has been claimed in the present petition, the petitioner has served a legal notice on 17.09.2018 (Annexure P-4), which is still pending NARESH KUMAR 2018.12.

CWP-30416-2018 -2consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice.

In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 17.09.2018 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
