This is a Civil Writ petition under Article 226/227 of the Constitution of India for issuance of an appropriate writ especially in the nature of mandamus directing the respondents no.3 to 7 for not sending the petitioners for Lower School Course 2025 as the petitioners have been selected for the promotion List B-1 under 35% seniority-cum-fitness category which is likely to commence in the month of June, 2026. 2.
Learned counsel for the petitioners has submitted that the Coordinate Bench of this Court in CWP-7040-2026 which was decided on 10.03.2026 had disposed of a similar writ petition by directing the respondents to re-consider the case of the petitioners for the purpose of
undergoing Lower School Course List B-1 of the year 2024 in the light of the judgment of the Co-ordinate Bench passed in the case of EHC Sandeep Kumar and others vs. State of Haryana and others, CWP-24483-2025. The order dated 10.03.2026 passed by the Co-ordinate Bench which has been highlighted by the learned counsel for the petitioners is reproduced herienbelow:- "Present:- Mr. Balkar Singh, Advocate for the petitioners. In the present writ petition, the petitioners have challenged the order dated 01.12.2025 (Annexure P-1) passed by respondent No.2, vide which, the petitioners have been selected for promotion course List B1 of the year 2024, which is scheduled to be held w.e.f. March, 2026 at HPA Madhuban, whereas, the petitioners have given their unwillingness to undergo the course.

Learned counsel appearing on behalf of the petitioners submits that similar issue has been considered by this Court in CWP24483-2025 titled as EHC Sandeep Kumar and others Vs. State of Haryana and others and the same was disposed of vide order dated 04.09.2025, wherein, it has been held that the petitioners cannot be compelled to undergo Lower School Course and thereafter, seek promotions.

Mr. Ravi Partap Singh, DAG, Haryana, accepts notice on behalf of the respondents-State and submits that aggrieved against the order dated 04.09.2025 passed by a Coordinate Bench of this Court in the case of Sandeep Kumar (supra), LPA-122-2026 titled as State of
Haryana and others Vs. Sandeep Kumar and others has been filed by the State, in which, notice of motion has been issued, but no interim order has been passed.

Taking into consideration that the similar issue has already been decided in the case of Sandeep Kumar (supra) and there is no interim order passed in LPA-122-2026, the present writ petition is disposed of with a direction to the respondents to re-consider the case of the petitioners for the purpose of undergoing Lower School Course List B1 of the year 2024 in light of Sandeep Kumar's case (supra). 6.
The present writ petition is disposed of in the abovesaid terms.

Mr. Aakash Singla, Addl.A.G. Haryana, appears and accepts notice on behalf of the respondents. Learned counsel for the respondents has submitted that although LPA has been filed but no interim order has been passed in the said LPA as has been noticed by the Co-ordinate Bench of this Court. The case of the petitioners is absolutely similar to the case of EHC Kaaraj Singh and others, CWP-7040-2026 which was disposed of by the Co-ordinate Bench of this Court vide order dated 10.03.2026. 5.
Accordingly, the present petition is disposed of with a direction to the respondents to reconsider the case of the petitioners for the purpose of
undergoing Lower School Course List B-1 of the year June 2026 in the light of Sandeep Kumar's case (supra).
