**** JAISHREE THAKUR, J. (ORAL) It is contended that the petitioner had submitted an application seeking voluntary retirement on 08.08.2016 giving three months notice period. The application ought to have been accepted within a period of three months which would make the date of retirement as 11.11.2016, if there was no rejection to the application within a specified period of three months. The petitioner herein has been relieved w.e.f. 09.12.2016 which is beyond the period of acceptance of notice. The limited prayer of the petitioner herein is that the representation dated 14.12.2016 to be decided in terms of the law settled by the Hon'ble Apex Court in State of Haryana vs. S.K. Singhal, AIR 1999 SC 1829 wherein it has been held that the applicant will be deemed to have retired from service from the date of expiry of the notice.
I have heard learned counsel for the petitioner. In view of the limited prayer made, without going into the merits of the case, this petition is disposed of with a direction to the Satyawan 2017.03.
CWP No. 5075 of 2017 -2petitioner to file a fresh representation to respondent No.2 within a period of two weeks along with the certified copy of this order, who in turn, on receipt of the said representation, is directed to decide the same by passing a speaking order in accordance with law within a period of three months thereafter.
Writ petition stands disposed of.
