It is contended that the petitioner is the son of a deceased government employee (Baldev Singh) who died while in service on 11.03.2011. Even though, at the time of death of his father, his mother was working as a regular employee of the Government, the petitioner would be entitled to employment on compassionate ground. In this regard reliance has been placed upon para 11 of the instructions issued by the Government dated 21.11.2002 (Annexure P-3) wherein a conscious decision is to be taken as to whether the family member would be able to sustain on the wages/pay of the earning member.

Against the rejection of his claim for compassionate appointment, an appeal has already been preferred which is still pending consideration before respondent No.1.

At the present moment, learned counsel appearing on behalf of the petitioner limits his prayer to an early disposal of the Appeal dated 03.02.2016 (Annexure P-5) which is pending consideration before respondent No.1.
I have heard learned counsel for the petitioner and without going into the merits of the case, this petition is disposed of with a direction to respondent No.1 to consider and decide the Appeal dated 03.02.2016 (Annexure P-5), by passing a speaking order in accordance with law within a period of two months from the date of receipt of certified copy of this order.
