Present petition has been filed under Article 226 of the Constitution, inter alia, for directing the respondents to release / refund final payment of CPF deducted from the salary of petitioners. 2.

In response to notice of motion, reply by way of affidavit dated 30.09.2022 of Sh. Vijay Kumar, Executive Engineer, Water Supply & Sanitation, Division No. 1, Gurdaspur, on behalf of both respondents, has been filed. Same is taken on record and copy thereof supplied to the opposite side. Registry will tag the reply at appropriate place. 3.

Paras-6 & 7 of the above affidavit read as under:- " 6.

That in compliance with the directions of the Hon'ble Court, the similarly situated employees were ordered to be covered under the Old Pension Scheme by counting their service rendered prior to the date of their regularization and accordingly all the petitioners of this case also were allotted GPF Numbers.

That the amount of contributions paid by the petitioners under the New Pension Scheme has since been released in their favour."

CWP No. 30476 of 2018 (O&M) -24.

A perusal of extracted paragraphs hereinabove, reveals that amount of CPF deducted from the salary of petitioners, has been refunded through their respective accounts, and as such, prime grievance stands redressed. The details of amount so paid under the New Pension Scheme, is also enclosed with reply as Annexure R-1.

So far as the relief of interest on delayed payment is concerned, the petitioners would be at liberty to raise their grievance before the authority concerned and same shall be considered as per law within next three months.

With the above observations, present writ petition is disposed off.
