The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India seeking issuance of a writ in the nature of mandamus directing respondent No.2 to decide the appeal and the stay application filed by the petitioners within a time bound period. 2.

Learned Senior Counsel appearing on behalf of the petitioners submitted that the petitioners had filed a statutory appeal before the the Joint Development Commissioner, Rural Development and Panchayat, Punjab under Section 11 of the Punjab Village Common Lands (Regulation) Act, 1961 and along with the said appeal, an application for stay of the operation of the impugned order was also filed. He further submitted that the aforesaid stay application is pending for the last more than one year but the same has not been CHETAN THAKUR 2026.07.02 18:35 I attest to the accuracy and authenticity of this order/judgment.

CWP-19574-2026 -2decided and his limited prayer is only to the extent that the said application for stay may be decided within any time frame work. 3.

At this stage, Ms. Shruti, Assistant Advocate General, Punjab submitted that considering the limited prayer made by the learned Senior Counsel appearing on behalf of the petitioners seeking a direction for deciding the application for stay within any time frame work, she has no objection in case any such direction is issued for fixing any time frame work. 4.

In view of the above, this Court is of the considered view that the present petition can be disposed of at this stage even without issuing notice to the respondents since the prayer of the learned Senior Counsel appearing on behalf of the petitioners is only to the limited extent of seeking a direction for deciding the application for stay within any time frame work. 5.

Consequently, the present Civil Writ Petition is disposed of with a direction to the the Joint Development Commissioner, Rural Development and Panchayat, Punjab, to consider and decide the application for grant of stay in accordance with law after affording adequate opportunity of hearing to the petitioners, within a period of six weeks from today. It is further directed that till the decision of the said stay application, no coercive steps shall be taken against the petitioners.
