(Oral) The primary grievance of the petitioner in the present writ petition filed under Articles 226/227 of the Constitution of India, was restraining the respondent-Bank to proceed with the auction proceedings, scheduled for 24th March, 2017, in pursuance to the order dated 09th February, 2017 (Annexure P-7) and the proclamation of sale dated 09th February, 2017 (Annexure P-8). It was further prayed that the respondentBank should not proceed further till the Objection Petition dated 03rd March, 2017 (Annexure P-9), challenging the proclamation of sale is decided. 2.

Upon notice of motion having been issued, Mr. C.S. Pasricha, Advocate, has put in appearance on behalf of the respondents and submitted that in auction scheduled for 24th March, 2017, the respondents have not been able to get any bid. It was thus prayed that in such a situation, the present writ petition has been rendered infructuous and may be disposed of as such. 3.
