Bhoop Singh v. Suwa Lal And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA
AT CHANDIGARH FAO-2860-2015 Date of Decision: September 26, 2019 Bhoop Singh .....Appellant
Versus
Suwa Lal and others ......Respondents CORAM: HON'BLE MS.JUSTICE NIRMALJIT KAUR
Present:
Mr.Akash Vashisth, Advocate for Mr.Sanjay Vashisth, Advocate for the appellant.
Mr.Vinod Gupta, Advocate for respondent No.3-Insurance Company.
........
NIRMALJIT KAUR, J. (ORAL) Learned counsel for the appellant, while praying for enhancement, submitted that the petitioner was a skilled labourer. He was a Constable in Haryana Police and thereafter he also applied for Jail Warden, whereas his income has been assessed as applicable to an unskilled labourer. Admittedly, the appointment of appellant as a Constable was set aside by the High Court and a simple application for the post of Jail Warden does not give him a status of a skilled labourer. Even if it is assumed that he was a skilled labourer, his income has been assessed as `6,000/- per month, whereas income of a skilled labourer, as per the schedule at that time was `5400/-. Further 50% has also been granted to him towards future prospects.
In view of the above, the present appeal is dismissed. September 26, 2019 ( NIRMALJIT KAUR ) meenuss JUDGE 1.
