(ORAL) Ex-facie, the instant revision petition is premature, since parallelly an appeal has also been filed against the trial Court order impugned herein, vide which application under Order 39 Rules 1 and 2 CPC has been allowed against the petitioner. The appeal is slated for hearing and at the same time, without exhausting the appellate remedy, the petitioner has chosen to file the instant revision petition. On that short ground alone, no ground for interference by this Court is made out. Dismissed. 2.

At this stage, learned counsel for the petitioner wishes to withdraw the present petition.
