The petitioner by way of this writ petition has come again praying for quashing of the transfer order dated 30.06.2023 (Annexure P-5) and 10.07.2023 (Annexure P-9).

The petitioner had earlier filed CWP-14121-2023, whereby, this Court vide order dated 06.07.2023 directed as under:- "After arguing for sometime, learned counsel for the petitioner seeks permission of this Court to withdraw the present writ petition, with liberty to pursue his representation before the concerned authority.

Disposed of as withdrawn with the liberty aforesaid. If such a representation is filed, the same shall be decided expeditiously."

Learned counsel for the petitioner submits that the said order was conveyed along with a representation to the office of the Block Development and Panchayat Officer, Sri Muktsar Sahib but no decision has come and therefore, he has filed the present writ petition wherein he submits DINESH BANSAL 2023.08.22 18:18 I attest to the accuracy of this order Chandigarh

CWP-18022-2023 -2- 2023:PHHC:108491 that the petitioner being a physically handicapped person, ought not be disturbed from his present place of posting.

I have heard learned counsel for the petitioner at length and have considered the submissions.

Subsequent writ petitions filed by the petitioner emanating to transfer would not be maintainable. This Court no where allowed the petitioner to file a fresh petition.

Keeping in view the above, the present petition is found to be wholly misconceived and deserves to be dismissed. Even otherwise on merits too, no case for interference is made out as the transfer policy is not enforceable in law and thus, prayer for transfer would not be maintainable. 7.
