On 03.11.2021, the following order was passed:- "Jagdeep Singh @ Babbu-petitioner is seeking anticipatory bail under Section 438 Cr.P.C in the case bearing FIR No. 54 dated 01.10.2021 under Sections 354/506 IPC, 1860, registered at Police Station Sudhar, District Ludhiana.

Briefly, the case has been registered on the basis of a complaint submitted by the complainant alleging that her husband is residing abroad. The complainant along with her son aged about 08 years are residing in their house. The petitioner is residing in their neighborhood and he had been roaming about in front of the house throughout the day. He had also been throwing inappropriate letters in the house. The petitioner had also stolen the mobile phone and had been blackmailing the complainant on account of photographs saved in the mobile phone. On 13.07.2021, Gurpreet Singh, the brother of the complainant met the petitioner while he

-2- was roaming in front of her house and they had entered into an quarrel.

It has been contended by the learned counsel for the petitioner that on 13.07.2021, the brother of the complainant had inflicted injuries upon him and he was medico legally examined at CHC Sudhar, Ludhiana. Six injuries were inflicted on his person as per MLR dated 14.07.2021 (Annexure P-1). The matter was also reported to the police on 14.07.2021 and an entry in general diary bearing No.25 dated 10.09.2021 has been recorded. It has been stated that the present FIR has been registered as a counter blast and to create a false defence version by the complainant in connivance with her brother.

Notice of motion.

Ms. Ruchika Sabharwal, AAG, Punjab, accepts notice on behalf of the respondent-State.

Adjourned to 19.01.2022.

Meanwhile, it is directed that in the event of arrest, the petitioner be admitted on interim bail on furnishing bail bonds to the satisfaction of the Arresting Officer subject to the condition that he join the investigation and comply with other conditions as specified under Section 438(2) Cr.P.C.."

Learned counsel for the petitioner has contended that the petitioner has since joined the investigation and has fully co-operated with the Investigating Officer.

Learned counsel for the State, on instructions from ASI Gurcharan Singh, has stated that the petitioner has since joined investigation and that he is not required for further custodial interrogation as of now.

-3In view of the above, the order dated 03.11.2021 is made absolute. The petitioner shall, however, join investigation as and whencalled. The petitioner shall also abide by all the terms and conditions as specified under Section 438(2) of the Code of Criminal Procedure, 1973. Disposed off accordingly.
